Key Changes from the Residential Tenancies Amendment Act 2024
Online Bond Lodgement - Bonds must now be lodged and paid online, eliminating the need for signatures or manual submissions.
Tenancy Terminations - From January 30, 2025:
- Landlords can now end a periodic tenancy with 90 days’ notice (no cause required).
- A 42-day notice applies if the landlord or a family member will live in the property, or if the property is sold or required for employees.
- Fixed-term tenancies will now default to periodic unless either party gives notice 90–21 days before expiry.
Retaliatory Termination Protection - If a landlord issues a termination notice in response to a tenant asserting their rights (e.g., requesting maintenance), the Tenancy Tribunal may overturn the notice and impose penalties.
Electronic Notices - Tenants and landlords can now use email or other digital platforms to serve notices, provided an electronic address is listed in the tenancy agreement.
Smoking Ban Clarifications - Smoking bans in tenancy agreements (excluding outbuildings) are now enforceable by the Tenancy Tribunal.
Pet Regulations (Effective Date TBC) -
- Tenants must have written consent to keep a pet.
- Landlords can only refuse a pet on reasonable grounds.
- Pet bonds (up to two weeks’ rent) may be required.
- Tenants are fully responsible for any pet damage beyond fair wear and tear.
